The relevance of the research problem is due to the need for theoretical justification for determining the structure of the principles of legal responsibility. The purpose of the article is to clarify the structure of the principles of legal responsibility in Ukraine. The leading methodological approach of the research is the structural-functional approach, which allows to consider the principles of legal responsibility as elements of the normative part of the legal system, which have their own functional purpose. Hacker provides comparative studies of a range of topics--including Wittgenstein's philosophy of psychology, conception of grammar, and treatment of intentionality--and defends his own Wittgensteinian conception of philosophy.

This paper is about the good side of modal logic, the bad side of modal logic, and how hybrid logic takes the good and fixes the bad.In essence, modal logic is a simple formalism for working with relational structures . But modal logic has no mechanism for referring to or reasoning about the individual nodes in such structures, and this lessens its effectiveness as a representation formalism. In their simplest form, hybrid logics are upgraded modal logics in which reference to (...) individual nodes is possible.But hybrid logic is a rather unusual modal upgrade. It pushes one simple idea as far as it will go: represent all information as formulas. This turns out to be the key needed to draw together a surprisingly diverse range of work . In recent years philosophers have given much attention to the ‘ontological problem’ of events. Donald Davidson puts the matter thus: ‘the assumption, ontological and metaphysical, that there are events is one without which we cannot make sense of much of our common talk; or so, at any rate, I have been arguing. I do not know of any better, or further, way of showing what there is’. It might be thought bizarre to assign to philosophers the task of ‘showing what (...) there is’. They have not distinguished themselves by the discovery of new elements, new species or new continents, nor even of new categories, although there has often been more dreamt of in their philosophies than can be found in heaven or earth. It might appear even stranger to think that one can show what there actually is by arguing that the existence of something needs to be assumed in order for certain sentences to make sense. More than anything, the sober reader will doubtlessly be amazed that we need to assume, after lengthy argument, ‘that there are events’. (shrink)

This paper argues that in modern (agro)biotechnology, (un)naturalness as an argument contributed to a stalemate in public debate about innovative technologies. Naturalness in this is often placed opposite to human disruption. It also often serves as a label that shapes moral acceptance or rejection of agricultural innovative technologies. The cause of this lies in the use of nature as a closed, static reference to naturalness, while in fact “nature” is an open and dynamic concept with many different meanings. We propose (...) an approach for a dynamic framework that permits an integrative use of naturalness in debate, by connecting three sorts of meaning that return regularly in the arguments brought forward in debate; cultural, technological, and ecological. We present these as aspects of nature that are always present in the argument of naturalness. The approach proposes a dynamic relation between these aspects, formed by gradients of naturalness, which in turn are related to ethical concerns. In this way we come to an overview that makes it possible to give individual arguments a relative place and that does justice to the temporality of the concept of nature and the underlying ethical concerns stakeholders have in respect to innovation in agriculture. The widely cited Nuffield Council on Bioethics ‘Intervention Ladder’ structurally embodies the assumption that personal autonomy is maximized by non-intervention. Consequently, the Intervention Ladder encourages an extreme ‘negative liberty’ view of autonomy. Yet there are several alternative accounts of autonomy that are both arguably superior as accounts of autonomy and better suited to the issues facing public health ethics. We propose to replace the one-sided ladder, which has any intervention coming at a cost to autonomy, with a two-sided ‘Balanced Intervention (...) Ladder,’ where intervention can either enhance or diminish autonomy. We show that not only the alternative, richer accounts of autonomy but even Mill’s classic version of negative liberty puts some interventions on the positive side of the ladder. (shrink)

Richard Taylor was born in Charlotte, Michigan on 5 November 1919. He received his A. B. from the University of illinois in 1941, his M. A. from Oberlin College in 1947, and his Ph. D. from Brown University in 1951. He has been William H. P. Faunce Professor of Philosophy at Brown University, Professor of Philosophy (Graduate Faculties) at Columbia University, and Professor of Philosophy at the University of Rochester. He is the author of about fifty articles and of five (...) philosophical books. This volume consists of essays presented to Richard Taylor on the occa sion of his sixtieth birthday. Some of the contributors have been Taylor'S students; some have been his colleagues; and all have been, and continue to be, his admirers. I have made several attempts to articulate what it is I (I would not presume to speak for anyone else) admire about Richard Taylor: (1) There is a particular 'flavor' to Taylor's philosophical writing and con versation that is wholly delightful. Like any other flavor, it can be tasted and enjoyed and remembered but never adequately described. (If there should be someone who has picked up this book who does not know what I mean, I recommend that he read the chapter on 'God' in Taylor's Metaphysics. ) (2) Taylor is a masterful dialectician. Philosophers often distinguish in some way between two senses of life's meaning. Paul Edwards terms these a ‘cosmic’ and ‘terrestrial’ sense. The cosmic sense is that of an overall purpose of which our lives are a part and in terms of which our lives must be understood and our purposes and interests arranged. This overall purpose is often identified with God's divine scheme, but the two need not necessarily be equated. The terrestrial sense of meaning is the meaning people find (...) in their own lives apart from the place of their lives in any ultimate end or context. (shrink)

In this paper we discuss two hybrid languages, ℒ and ℒ, and provide them with complete axiomatizations. Both languages combine features of modal and classical logic. Like modal languages, they contain modal operators and have a Kripke semantics. Unlike modal languages, in these systems it is possible to 'label' states by using A and ↓ to bind special state variables.This paper explores the consequences of hybridization for completeness. As we shall show, the challenge is to blend the modal idea of (...) canonical models with the classical idea of witnessed maximal consistent sets. The languages ℒ and ℒ provide us with two extreme examples of the issues involved. In the case of ℒ, we can combine these ideas relatively straightforwardly with the aid of analogs of the Barcan axioms coupled with a modal theory of labeling. In the case of ℒ, on the other hand, although we can still formulate a theory of labeling, the Barcan analogs are not valid. We show how to overcome this difficulty by using COV*, an infinite collection of additional rules of proof which has been used in a number of investigations of extended modal logic. (shrink)

KyawI used to work as a medical doctor in a less developed state than many big cities in Burma1 that experienced prolonged civil wars and current similar atrocities decades before the urban areas of the country experienced them. Before everything started, I was responsible for the medical management of the most vulnerable communities and had been struggling (...) with pandemic-related medical activities. Those were the happiest years of my life. I was with one of the best international organizations, where every effort I made was directly delivered to the patients with no unnecessary paperwork. The system was efficient, my colleagues were supportive, and I had a good work-life balance. I supported my family and whoever needed temporary financial support, played music weekly, met good friends who I hung out with every weekend, and [End Page 164] found hobbies like gardening and crocheting. I was content and happy. I even postponed my plans to get registered as a doctor in the Western world.Before moving to this beautiful ethnic state in 2019, I previously worked as a government medical doctor in Yangon, the capital. As much as I loved working in those civilian hospitals, I could not support myself with a monthly pay of $100-$150 USD. It was a hard decision to leave the service because it meant I could not pursue the medical specialty that I had always longed for and had to leave like-minded supportive colleagues. In Myanmar, unless you are a civil servant, you cannot pursue further clinical specialties. However, after leaving the government’s service to work in humanitarian medical assistance in hard-to-reach areas of Burma, I learned that life is still beautiful outside my comfort zone, until February 2021 when the coup began. Democratically elected members of the country’s ruling party were overthrown by the military, which then bestowed power in a military junta.I expected the election prior to the coup in November 2020 to be an uphill battle for Burma, but nothing more. I was still in denial when I first heard the news from one of the town’s NGO staff. The person had to travel on a motorbike to inform everyone that the junta had staged the coup. No telephone or internet was working at that time. My colleagues and I cried in our office, saying, “We are so young, and the future is still ahead. I don’t think this is going to last long. Maybe it will be over in a few days or, at most, a few weeks.” Once the peaceful protests started nationwide, my friends and I provided medical cover for the protesters, initially for minor medical problems such as low sugar, low blood pressure, injuries from accidental minor slips and falls, etc. Never in my life had I imagined that I would be taking care of bullet wounds and people injured by live rounds. While learning about gunshot wounds in forensic medicine, I thought, “Oh, this is not going to be very useful because Burma is not America, and I am not going there.” Then suddenly, it became too real and more useful than I would’ve liked it to be.I always think back to one especially bloody day when many people in the town were shot with live rounds. We assisted many patients. Usually, we would go around with the protest groups until they were over in the late afternoon. The protesters were always peaceful. There were no riots, no harmful acts, or vandalism. Only when the protesters were cruelly dispersed with tear gas, high-pressure pumps, rubber bullets, and live rounds (to the head) did they decide to defend themselves while still making their voices heard. The only defenses people had to counteract the live rounds were things like metal covers, firecrackers, and slingshots.One afternoon in March 2021, my team and I took an early break for lunch—unaware that some people would lose their lives that afternoon. Jewish law takes an approach to self-defense that differs dramatically from the conventional assumptions of Western secular legal systems. The central theme of Talmudic jurisprudence is that self-defense rests on a duty not to stand idly by while one's neighbor suffers. “Do not stand on the blood of one's neighbor,” as the point is cryptically put in Leviticus 19:16. This way of thinking about self-defense departs in two significant ways from common Western assumptions. First, it stresses that the roots of (...) self-defense are a duty rather than a right to act; second, it treats the case of third-party defense as logically prior to the first-party case of self -defense. The logical positivists’ critical attitude towards metaphysics is sketched. Strawson’s conception of descriptive and revisionary metaphysics is described. Revisionary metaphysics is argued to be chimerical, and descriptive metaphysics is argued not to be a form of metaphysics at all. Strawson’s failure to account for the status of propositions of descriptive metaphysics is held to be remediable by reference to Wittgenstein’s conception of grammatical propositions that express norms of representation.

This article examines the origin of experiential organization, especially whether it is salient or selective. Aron Gurwitsch believes it is salient and William James that it is selective. I argue that Gurwitsch is right, and recount his argument and his critique of James, but I also pose my own critique and critical questions on the issue. -/- Gurwitsch's argument attempts to show that the organization of consciousness is not arbitrary or merely selected in some way by the subject. He claims (...) that when consciousness is organized it is found as already organized. -/- This is important for Gurwitsch's philosophical system because if he can establish that consciousness is always originally organized, then his famous claim that the theme, thematic-field, margin structure of consciousness is an invariant patterning impervious to the subject's whim, mood, or possible noetic training, is protected at the very start. This paper provides a methodological schema for interpreting Hume's Dialogues concerning Natural Religion that supports the traditional thesis that Philo represents Hume's views on religious belief. To understand the complexity of Hume's ‘naturalism’ and his assessment of religious belief, it is essential to grasp the manner in which Philo articulates a consistently Humean position in the Dialogues.

1. Belief and mental statesDavidson holds that intentional verbs occurring in the form ‘A Vs that p’ signify propositional attitudes. These are, he claims, mental states, and dispositions. Davidson does not conceive of himself as introducing a special technical sense of the common intentional verbs. He insists that ‘the mental states in question are beliefs, desires, intentions, and so on, as ordinarily conceived'. Consequently he contends that believing that p is a mental state, disposition or dispositional state. These ontological claims (...) about the nature of belief inform his account of the logical form of belief sentences. I shall address the question of whether believing that p can justly be deemed a mental state, a disposition or dispositional state. Subsequently I shall examine Davidson's account of the logical form of belief sentences.Our concept of a mental state, like so many of the concepts which philosophers treat as categorial, is none too sharply defined. It has a respectable use, which can be described. But, like other such general psychological terms, e.g. ‘mental process’, ‘mental activity’, far from being the ‘hardest of the hard’ - a sharply circumscribed categorial term akin to a variable in a well-constructed formal system — it has blurred boundaries and is elastic. Like all our ordinary psychological concepts, it evolved in order to meet everyday needs. As Wittgenstein observed, ‘The concepts of psychology are just everyday concepts. They are not concepts newly fashioned by science for its own purposes, as are the concepts of physics and chemistry.’Although our ordinary concepts can be replaced by technical ones for specialized purposes, they cannot be abused without generating conceptual confusion and incoherence. If the expression ‘mental state’ is being employed in its ordinary sense, then it is wrong to hold that believing that p is to be in any mental state. If it is being employed in a special technical sense, then those who employ it thus owe us an account of what it means and how it is to be used. This Davidson and the many other philosophers who subscribe to the view that believing is a mental state have not done. Until such an account is forthcoming, one may presume that they think of themselves as deploying our ordinary concept of a mental state. And if so, I shall argue, they are misusing it. (shrink)

In 1956, a few writings of Wittgenstein that he didn't publish in his lifetime were revealed to the public. These writings were gathered in the book Remarks on the Foundations of Mathematics (1956). There, we can see that Wittgenstein had some discontentment with the way philosophers, logicians, and mathematicians were thinking about paradoxes, and he even registered a few polemic reasons to not accept Gödel’s incompleteness theorems.

To stimulate research and innovation (R&I), to contribute to the solution of societal challenges and to align R&I with societal values, the European Commission has launched the governance framework of Responsible Research and Innovation (RRI). RRI figures in many high-level EU policies as a means to promote smart growth, and a growing community of R&I practitioners from both the public and private sectors appears committed to it. Although debates on what RRI precisely entails have not reached closure yet, RRI provides (...) an interesting avenue to explore ways of making R&I more societally germane. While recognizing the usefulness of keeping critical reflection on RRI’s meaning alive, we suggest that to make the step from theorizing to implementation, RRI could benefit from a clearer conceptualization. This chapter presents the iterative trajectory in conceptualizing RRI followed as part of RRI Tools, one of a number of EC-funded research projects and support acts aimed at fleshing out what RRI can and should be, and the conceptualization of RRI that this led to. It suggests that RRI is best captured if in R&I governance attention is paid to the five p’s of Purpose, Products, Processes, Preconditions and People, and that further elaborations on the meaning of RRI should happen in dialogue with attempts at practicing RRI. But here it strangely overemphasises the internal security of the cottage, whose only other occupant was the slave-woman Scybale, and she, unlike the usual run of pilfering servants , was its unica custos . More important, claui usurps the place which sense and style alike require for the substantive qualified by the participle clausae. , 438, suggested that it was a substantive.
